Anasayfa / Makalelerimiz / Power of Attorney in Alanya

If you cannot attend procedures in person, a well-drafted Power of Attorney (POA) allows a trusted representative—often your lawyer—to act on your behalf in Turkey. In Alanya, we prepare bilingual POAs, coordinate sworn translation, notary, and (when signed abroad) apostille/legalization, then handle filings for real estate, banking, corporate, and court matters.

Real estate: reservation, title deed (Tapu) transfer, mortgage release, utility subscriptions.
Banking & finance: open/close accounts, accept SWIFT, obtain IBAN, receive bank statements.
Corporate: company formation, share transfer, signatory changes, tax and SGK procedures.
Litigation & enforcement: represent before courts/enforcement offices; mandatory mediation attendance.
Administrative: municipality, notary, population & tax offices.
Tip: For one-off transactions, narrow the POA to the specific property (block/parcel/independent section), bank, or case—this boosts security and trust.
Drafting: We prepare a bilingual (TR–EN/RU) POA tailored to your purpose.
Translator & Notary: You attend an Alanya notary with a sworn translator; notary reads the text in Turkish, translator confirms accuracy.
Execution: You sign; the notary seals the original.
Delivery: We pick up the notarized POA and start the requested procedure (Tapu, bank, court, etc.).
What to bring: Passport, local contact details; Turkish tax number if available (we can arrange). Some notaries may request biometric photo for certain POA types.
Drafting: We send you the exact Turkish text approved by the Alanya notary/court/bank.
Execution abroad:
If your country is a Hague Apostille member: sign at a local notary, then obtain an apostille from the competent authority.
If not a member: sign and then obtain consular legalization (Turkish Consulate or the route your country requires).
Sworn Turkish translation in Turkey (if signed in a foreign language), and notarial certification of that translation.
Use in Turkey: We lodge the POA with Tapu/Bank/Court and proceed.
Need help deciding the route? Contact us—process differs by country, document language, and target authority.
Who translates? Only sworn translators registered with the notary.
Language choice: The authoritative language is typically Turkish. Bilingual layout avoids misunderstandings; we add a controlling language clause.
Names & IDs: We mirror passport spellings (Latin transcription), add parents’ names when needed by registries, and ensure addresses match utility/tax records.
Cross-link for contracts and notices: Alanya Contract Lawyer.
Valid passport (+ copy); residence permit card if any.
Tax number (we can obtain).
Local mobile/WhatsApp and email for notices.
Sworn translator booking (we arrange).
Draft POA (TR + EN/RU) clearly limiting scope, duration, and revocation terms.
If property-specific: Address + block/parcel/independent section; seller/developer details if relevant.
If things go wrong (e.g., wrong parcel number or missing mediation authority), disputes may follow—know your options at Real Estate Contract Cancellations in Alanya and Alanya Debt Collection Lawyer.
For off-plan or resale transactions we usually include powers for:
Signing the sales contract, receiving preliminary documents, and Tapu transfer.
Payment confirmations, escrow releases, refund/compensation claims if delivery is delayed.
Utility activation/termination and DASK/insurance procedures.
Deep-dive on delivery and penalties: Alanya Construction Law Lawyer.
Apostille: Fastest where available; confirms the notary/public official’s authority. After arrival in Turkey, we arrange sworn translation + notarial certification of that translation.
Consular legalization: Used when apostille is not available; the Turkish Consulate (or another chain) authenticates the document. Allow extra time.
Validity: Turkish authorities accept both routes if properly completed and translated.
Scope & duration: Limit to the exact transaction and set an expiry date.
Named attorney(s): Authorize a specific attorney (or firm) rather than “any bearer”.
Revocation: Keep a revocation clause ready; notify counterparties and relevant registries if you cancel.
Copies: Keep scanned copies; originals are needed for Tapu and some banks.
Data protection: We store POAs under strict confidentiality and delete after matter closure per policy.
In-Turkey notary route: often same day once your draft and translator are ready.
Abroad + apostille: usually a few business days to a couple of weeks depending on local authorities.
Translations: same-day to 48h depending on volume.
(Exact fees/timings vary by notary and country; we provide a fixed quote up front.)

1) Can I issue a POA entirely in English?
You can sign in English abroad, but Turkish authorities typically require a Turkish translation notarized in Turkey. We provide bilingual drafts to avoid inconsistencies.
2) Does the POA need an apostille?
Only if signed outside Turkey (and your country is an apostille member). If not, use consular legalization. If you sign in Alanya at a notary, no apostille is needed.
3) Can one POA cover Tapu, bank and court?
Yes, but we advise separate or tightly limited POAs for security and easier revocation.
4) How long is a POA valid?
Until revoked or expired per your clause. Some institutions prefer recent POAs—ask us for the right validity.
5) What if details are wrong (e.g., parcel number)?
We can issue a corrective POA or a supplemental notarized statement. For disputes or refunds, see Alanya Debt Collection Lawyer.
6) I live in Istanbul but the property is in Alanya—does it matter?
We can coordinate nationwide. If your deal spans provinces, our network supports you (see also Istanbul Contract Lawyer).
